My previous employer filed EB2 labor for me. I left the job after getting 140 approved so that I will hold the priority date.

The new employer, as per their policy is planning to file labor application in EB3 category and NOT in EB2 category.

My question is, the way I post PD from old approved 140, do I port the EB2 category also? ie will my PD get compared with EB2 PD or EB3 PD when it comes to filing 485?

I am a strong supporter of Comprehensive Immigraton Reform (CIR). I have been on both sides of the fence. In the late 1970s and early 1980s, I was an attorney for the Immigration and Naturalization Service. Hi, I have a H1B from company A stamped in my passport and it has been expired in sep 2005. I joined company B in march 2004 and I have their I-797 valis till Jan 2008. I am going to India to stamp it on the passport. Is their any issue with this ? I heard that if one is changing the comany, he/she has to stamp the H1B of the new company on the passport within 6 months or so. Please help.

I have applied for I-140 in Oct 2006 and hvn't recd I-140 yet (Nebraska)
My 485/EAD checks got encashed today. My questions is do I need I-140 before FP or EAD card.

My H1b got Approved and starts from OCT 1st and OPT Extension Expires in July 1st week.
I am travelling to India for 2 weeks in next month.

Do I need to go for Stamping? or my Current student status is valid :confused:

Hi,
Recently I transferred my H1 to another company. My H1 and my wife�s H4 got expired on last August 2nd 2007. However, the new company filed H1B application and it got approved 2 weeks back, but forgot to file for H4 extension for my wife. My company is saying they will file for H4 extension (I-539) now, even though her visa/I-94 got expired and she doesn�t have to go back home. Do you think they are on right track? I�d really appreciate if anyone could suggest me on this.

Hi one of my relative has cleared the US citizenship exam. He is waiting for the oath. He want to visit canada after a month. Before the canada visit I think the oath will be done and he will become citizen of US. He can not get the US passport instantly.

My questions:

1. After becoming US Citizen can he visit canada without US passport? If yes what docs he needs to carry with hi?

If no then what to do ? asking because he want to visit canada and can not get passport withn 15 day.

I need to respond to a RFE related to proving Programmer Analyst being a Speciaity occupation.

I researched and found a memo from Terrance Way, Director INS issued a memo on this on December 22, 2000 and is available on AILA Infonet

AILA InfoNet at Doc. No. 01040603

I couldnt locate this memo in USCIS policy guidance memoranda search.

Can some one with access to AILA Infonet, please send me this document
