    I have filed an appeal for a rejected I 140, which is I 290B.
    I also filed a new I 140 using the same labor (EB3, august 2003)

    Now I am seeing constant changes to LUDs to both status online, but the text doesnt change.
    I 290B had LUD change for 3 days, and I 140 had LUD change for 3 days too.
    I am confused now... does this mean they are working on the case?
    constant changes like these furstrate me when there is no message or text change in status.
    Can the gurus here predict according to similar trends? what can I expect?

    I believe some lawyers still do 245(i). The fee is $1k. Talk to an immigration lawyer or google "245 (i)"

    Thanks for your reply. I was off for a month and a half to complete a paper for my Masters and have proof for the same...I was not able to juggle both work and studies....will USCIS consider this excuse to be at home studying without pay?

    My biometrics appointment is scheduled at ATL ASC on the 19th of this month which is a Saturday. Has anyone on this forum visited ATL ASC for any work on a Saturday? Should I call up the USCIS customer service to reschedule my appointment? Or, do I need to be happily surprised to see my the USCIS working hard for me even on a weekend? ( The later part sounds like a 'Bizzaro World' from Seinfeld )

    Maybe they are going to advance the dates in the next visa bulletin to Jan 2006. Well something to think about for the number crunchers and the PD forecasters on this forum.

    mate take it easy. my appli's were sent to NSC on august 1st and i still haven't seen any receipts come through for 485, ead nor AP. Although I have received Ead card and done finger printing so that way I know what my 485 appli # is but no info on the AP

    There is a mistake in my 485 cover letter. The letter states that I am EB3 but actually I am EB2.

    Will this cause any problem? Will USCIS deny my case? Please note we included I-140 approval form in the file.

    Your cover Letter is not a USCIS document. As long as the actual application forms and supporting documents are good you should have nothing to fear.

    If you're already eligible to use AC21, then I see no problem working as consultant as long as it is of the same job category as your LC. ATP and location does not matter anymore.

    Can you use your spouse's cross-changeability after you have filed for your I-140 already ? How time consuming is this for the USCIS to acknowledge ?

    i am quite sure you can...infact you can do this at any stage including after filing I-485.
    please verify with an attorney...you will need one to do it correctly.

    I currently hold H4 visa. I got H1 approval (consular) this year. Now instead of applying by consular process (in London), I want to join my spouse on H4 and then apply for COS from within USA.

    1. Can I do this?

    2. If Yes, how? Which form do I have to fill ? Kindly detail the procedure with applicable costs.

    3. When I later, travel outside US, do I then have to have H1 visa stamped in my passport?

    4. If Yes, does this 1st visa have to be from home country or could be from Canada etc.?

    P.S. I do not have any educational or work background in USA.

    My wife will be coming back in April 2nd week through Denver. CO POE. Her AP is valid until June 3rd week.

    My question is that is 2 months of AP validity / cushion enough or safe to enter the US.

    Will she get a 1 year I-94 validity from the date of entry or only until her AP expires?

    This question has also been posted in the member forum and I have posted it here to get advice from the eminent lawyers from a legal standpoint.

    Hi All

    My wife changed her status from F2 to F1 and recently she went to India, so she had her visa stamping appointment on Feb 18. at the counter the visa officer told her that she hasnt paid the SEVIS fee so has to go outside and pay online and come back with the receipt. she did and went back and she was told that she has got the visa and the passport will be mailed to her. she hasnt received it yet (its about 8 working days now), and when i contacted the consulate they replied: "We have provided a pink sheet, which says that the SEVIS is not updated in the system. Once it gets updated the passport will be sent to the mailing address."

    1. is this delay a normal occurance and how long it takes in such case?

    2. do you guys see any problem in this case?
