To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.

I am trying to analyse the impact based on 245i. Based on it
PIC countries benefited from unused visas a lot till now to have their PD current/move up. So based on that benefit, Also one thing is clear the unused visas if available are country indepedent and are used at the rate of 27% per quarter.
so for example 100K visas are available (which i would enjoy having )27K per quarter is available from the start of the year . Now among this 27K how is the distribution, can it be distributed whichever applicant needs PD IRRESPECTIVE of EB1,EB2,EB3(skilled, professional) Vs EB3 other or does it split by the calculations of EB1, EB2, EB3 with 28% EACH and EB3 other NOT above 10K limit
can someone answer it?

Hi Friends,
I'm working with employer A and my PERM labor got certified with employer B. My second H1B duration ends Sep 2011 (12 months) and I can recapture 5 months.
1. Will I get 3 yrs of H1B extension if do the H1B transfer after my I-140 with employer B is approved.
2. Will I get 2 years of H1B extension (09/2011 + 1 yr with approved Labor) if I do H1B transfer now?
3. I went for a vacation and returned US just now. My employer A has generated pay stub only for a week and forgot to pay for the vacation. Is it Ok to submit partially paid last pay stub for the H1B transfer. FYI, I've all the other pay stubs for the previous months.
It'll really helpful to decide based on the folks replies. Thanks alot for the help.

Mine and my wife's 485 must have been "touched" today ... not sure why though. The status still says "Case received and pending..."

Thats correct. Once the I-140 is denied all the status' that comes with it goes away. So EAD, AP etc are no longer valid. Keep on extending H-1B and if the I-140 ever gets denied then you guys can move to H status.

And it's all legal.
"How I get them is my trade secret . . . but I get them all," said Walt Seager, who digs up the reports for Gallery Watch, a legislative tracking service.
The Congressional Research Service (CRS) was established in 1914 as Congress's supplier of nonpartisan research and analysis. Its reports are neither classified nor copyrighted, but they've long been the exclusive property of lawmakers, who distribute them as they see fit. Taxpayers supply the agency's $100 million annual budget, inspiring open-government groups and some lawmakers, including Sens. John McCain (R-Ariz.) and Patrick J. Leahy (D-Vt.) to push for public release of CRS reports.
Aftergood and others have fought back by posting every CRS report they can find on their Web sites. But watchdog groups have released only about 10 percent of the total, not enough to reveal the patterns that suggest what Congress might do next.
Subscribers to Gallery Watch pay about $4,000 a year to get all the CRS reports, online and searchable, delivered weekly.
At a recent meeting for potential customers, Riendeau explained that clients scan the reports for intelligence "kind of how the CIA operates," by spotting the political trends suggested by their contents and timing, he said. I'm in Spain this week so can't give the full treatment, but thanks to readers who sent this happy news. The US has won the Nobel Prize in medicine for work done by these two scientists as well as Carol Greider. Blackburn is Australian-born and Szostak is British-born. They received their award for genetic research that is described here.
