    Hi,

    I have my EAD/AP. I'm EB3-I.
    I paid my attorney for the 485 processing. But the law firm works for my company.
    They have been good so far (law firm) but I guess it would be better for me to first change the attorney If I plan to file AC21.

    I would appreciate it if someone can suggest me good attorney . What would be the fee I can be looking at to pay the new attorney at this point of my GC. processing( With EAD/AP ..renewal also taken care.)

    (If it is not appropriate to mention the figure I would appreciate it if someone can just give me a range/ballpark figure)

    Pew confirms what we've already assumed is happening. The number of illegally present immigrants has dropped 8% since 2007. The number is now about 11 million, down from peaking at 12 million. The annual migration of illegally present immigrants has dropped from about 850,000 a year a few years ago to just 300,000 a year today. Why?     Do you know where your congressman is? Until recently, few aside from staffers could have answered �yes.� But under increased pressure from watchdogs and the public, more lawmakers are disclosing with whom they�re meeting, as well as when and where.

    Rep. Kirsten Gillibrand (D-N.Y.) is a case in point. For instance, she had two hectic days of meetings, receptions and fundraising events at the end of May.

    On May 30, she met with American Insurance Group (AIG) officials, attended a meeting with Goldman Sachs employees to discuss sub-prime lending and alternative energy policies, sat down with Altria Group lobbyists to discuss tobacco regulation, and joined some of her business-friendly Democratic colleagues to meet with Morgan Stanley executives.

    She then hopped on a plane for a two-day fundraising swing through San Francisco and Los Angeles, where she attended a fundraiser with Sen. Hillary Rodham Clinton (D-N.Y.) and raised money for herself.

    This information normally is hard to come by for a reporter or government watchdog group. But during last year�s campaign, the Sunlight Foundation, a new watchdog, challenged lawmakers and candidates to publish their official work schedule online within 24 hours of the end of the workday.

    �My sixth sense about this is that greater transparency is an antidote to corruption and members of Congress get that,� the executive director of the Sunlight Foundation, Ellen Miller, said. �[California Republican Rep.] John Doolittle is a case in point. We�re at the tip of the iceberg. More and more will do it as citizens begin to understand it.�

    Gillibrand agreed to make her calendar public during the 2006 campaign, making it easier to see how she is using her time. Sen. Jon Tester (D-Mont.) also started posting his schedule when he arrived in Washington even though he did not sign the pledge, his spokesman Matt McKenna said.

    For Tester, open government is �a way of life in Montana,� McKenna said, adding that the reaction �has been all positive.�

    Six more lawmakers, Reps. Alcee Hastings (D-Fla.), Kathy Castor (D-Fla.), Jan Schakowsky (D-Ill.), Denny Rehberg (R-Mont.) and Doolittle and Sen. Bill Nelson (D-Fla.), have followed suit.

    The calendars provide a glimpse into the harried lives of the lawmakers, showing with whom they meet and how they manage their time and highlighting differences between the House and Senate.

    They also allow observers to link campaign donations to meetings.

    Gillibrand flew to Palo Alto, Calif., on May 30. A week earlier she gave $4,600 to Clinton�s presidential campaign. On June 2, Gillibrand met � the calendar does not say where � with Jayne Shapiro, a wealthy businesswoman, who gave $500 to the campaign. Gillibrand also met with Marsha Kwalwasser, an executive at Northrup Grumman, according to CQ Moneyline.

    Reporters and constituents love publicly posted schedules, and so do opposition researchers. MajorityAP.com, a Republican Web-based research service that provides information to reporters about Democratic lawmakers, accused Gillibrand of misleading the public by not stating where the event took place.

    �It�s reasonable that the people in her district know that she�s in California raising money during the Memorial Day recess,� the website�s founder, Michael Brady, said.

    A spokeswoman for Gillibrand said the missing location was a simple oversight, adding that Gillibrand�s office would look into adding the location.

    Miller said Tester�s schedule should be the standard that lawmakers emulate, but that more disclosure is better than none.
    Tester shares the same frenetic pace as Gillibrand, traveling, presiding over the Senate, sitting in committee hearings, meeting with constituents and huddling with Sen. Max Baucus (D-Mont.).

    Take June 21, for instance.

    Tester started the day at 9 a.m. with his senior staff, then attended a Senate Indian Affairs Committee hearing, met with a delegation from the PPL Corporation, presided over the Senate floor and lunched with former NBC anchorman Tom Brokaw.

    The lawmaker returned to his office to meet with constituents, hit the annual ice cream social, chatted with more constituents � including the winner of the National Peace Essay Contest � and met with an official from the American Bankers Association. He and Baucus huddled at 3:30 and the Senate met at 11 p.m. that evening.

    While editorial boards and government watchdog groups have praised the postings for adding transparency to the political process, each calendar has its shortcomings. Gillibrand and Schakowsky, for example, do not specify at what time each appointment occurred. Tester does not identify some people; Rehberg and Doolittle do not detail the time they spend politicking or raising money; and Hastings only lists his weekly schedule.

    Most lawmakers do not archive their schedules, although Congresspedia does.

    Castor, however, lists the times of her meetings and includes information on fundraising events she attends. She began posting her schedule in March.

    �She�s a very strong supporter of open government,� Castor�s spokeswoman, Agustina Guerrero, said.

    Below is my current GC & H1-B status

    1. Have an approved I-140 with my current employer. Waiting to file I-485.
    2. Pending H1-B extension petition based on approved I-140


    I'm looking to move from engineering to marketing with the same employer. I know I have to refile labor and I-140 and claim the PD based on the already approved I-140. Can I move to marketing from engineering? The job responsibilities are totally different and my current H1-B extension petition is for engineering position only. I need to file for a H1-B amendment based on the new marketing position.

    Will i be able to move smoothly within my current company. If not what will be some roadblocks? Any advice or insights is highly appreciated

    B1 is purely-non-immigrant-intent visa while H1 is dual-intent. Given this, I do not see any harm entering on B1 while you have a valid I-797 presumably starting Oct 1st? So, after returning you can appear for H1 visa stamp and later enter using H1.

    This is my personal opinion, please take attorney's advise.

    My wife is laid off and her company is going to cancel her H1B soon. h1 petition is getting expired on Oct,2009. now I am going to apply for COS to h4. If she wants get H1 status after one year can she use the same petition for H1 transfer?. or she has to apply a new H1?.
    Can you please help me.

    She has to apply for COS again from H4 to H1. It will not be subjected to the cap if she had H1 within last six years at the tme applying COS to H1

    My Situation:
    I am on H1B visa and working now with employer �A� (from Jun 10 to Till Date)
    I was working with employer �B� (from Jun 09 to Jun 10)
    I was previously also working with employer �A� (which is now my present employer) from Jul 08 to Mar 09,
    My H1 Transfer from employer �B� to �A� has been filed in last Jun 10 but it is in Process now.
    Now my present project is over, I have got a project with employer �C�
    My Questions:
    1. Can I join the employer �C� by filing another H1 transfer? as of now still my H1 Transfer (employer �B� to employer �A�) is in process.
    2. I have also got another project with my ex employer �B�, I can see the I797 petition of the employer �B� is still showing a status of approved in the USCIS state, it has not been reoked. Can I rejoin the ex employer �B� without filing any new H1 Transfer ( from employer �A� to employer �B�).

    Will appreciate your answer,

    I received my EAD but my spouse EAD did not arrive and it has been more than 2 weeks. The status says Card production Ordered.

    I ehard USCIS asks us to anyhow reapply, so should I have to wait untill the 30 days have passed to reapply for replacement ead or can I apply before?. Is there any way the process can be expedited as my spouse has to work on this EAD. Any info is really appreciated.

    Also can we work when we have the receipt for replacement card

    The Senate passed a sweeping energy legislation package last night that would mandate the first substantial change in the nation's vehicle fuel-efficiency law since 1975 despite opposition from auto companies and their Senate supporters.

    After three days of intense debate and complex maneuvering, Democratic leaders won passage of the bill shortly before midnight by a 65 to 27 vote.

    The package, which still must pass the House, would also require that the use of biofuels climb to 36 billion gallons by 2022, would set penalties for gasoline price-gouging and would give the government new powers to investigate oil companies' pricing. It would provide federal grants and loan guarantees to promote research into fuel-efficient vehicles and would support test projects to capture carbon dioxide from coal-burning power plants to be stored underground.

    Democratic leaders said they hoped the legislation will be a rallying point for voters concerned about national security, climate change and near-record gasoline prices.

    "This bill starts America on a path toward reducing our reliance on oil by increasing the nation's use of renewable fuels and for the first time in decades significantly improving the fuel efficiency of cars and trucks," said Sen. Harry M. Reid (D-Nev.), the majority leader.

    Final passage of the bill capped an otherwise rancorous week in which senators grappled over energy policy. Early yesterday, Democrats accused Republicans of obstruction after a $32 billion package of energy tax cuts was blocked on a procedural vote. But late in the day, a bipartisan group of senators came together to break an impasse on vehicle fuel-efficiency standards that would require cars, trucks and sport-utility vehicle to achieve 35 miles per gallon by 2020.

    Earlier in the week, the Senate rejected additions to the bill that would have pumped billions of federal dollars into efforts to ramp up production of a coal-based fuel for cars and trucks, which proponents had called an important alternative to petroleum. Additionally, Sen. John W. Warner (R-Va.) failed to win approval for a proposal to allow exploration for natural gas off the Virginia coast, and Republicans blocked an effort to require that more of the nation's electricity come for renewable sources.

    The passage of fuel-efficiency measure was viewed as a major triumph for the Democrats, particularly the last-minute dealmaking that enabled passage of the comprehensive change to mileage standards.

    The politics of fuel economy had gone virtually unchanged since Congress passed the first nationwide standards -- known as corporate average fuel economy, or CAFE -- in 1975. The last time the full Senate tried to boost fuel-economy standards was in 2002, and the effort was defeated handily.

    The auto industry successfully argued that large increases in efficiency standards would force them to build smaller vehicles -- the kind American consumers won't buy. In recent years, however, low mileage standards left U.S. automakers with little market defense against higher-mileage Japanese cars, particularly at times when gas prices soar. As consumers have moved gradually from SUVs and pickup trucks to smaller vehicles, Detroit's Big Three automakers have gone through a painful restructuring period.

    The United States, with current efficiency standards of 27.5 miles per gallon for cars and 22.2 per gallon for SUVs and small trucks, has lagged behind the rest of the developed world. In the European Union, automakers have agreed to voluntary increases in fuel-economy standards that next year will lift the average to 44.2 miles per gallon, according to the Pew Center on Global Climate Change. In Japan, average vehicle fuel economy tops 45 miles per gallon. China's level is in the mid-30s and projected to rise, propelled by government policy.

    The fuel-efficiency language in the Senate energy package originally had coupled a 35 mile-per-gallon standard with a requirement of 4 percent annual increases for the decade after 2020. A group led by the two Michigan senators -- Democrats Carl M. Levin and Debbie Stabenow -- and Sen. Christopher S. Bond (R-Mo.) had sought instead to gain support for an amendment that would impose less-stringent standards while satisfying growing demands for change in the fuel-efficiency laws.

    In the compromise-- shepherded principally by Sens. Ted Stevens (R-Alaska), Thomas R. Carper (D-Del.), Dianne Feinstein (D-Calif.) and Olympia J. Snowe (R-Maine) -- lawmakers dropped a provision that would have mandated additional 4 percent annual increases in fuel efficiency between 2021 and 2030. They also softened a provision that would have required all automakers to build substantially more vehicles that can run on ethanol and other biofuels.

    After the fuel-economy vote, Sen. Byron L. Dorgan (D-N.D.), another architect of the compromise, said the nation's desire to be less dependent on foreign oil would be a "hopeless journey" without more efficient cars and trucks.

    "Now, in our vehicles, we have better cup-holders, we have keyless entry, we have better music systems, we have heated seats," Dorgan said. "It is time that we expect more automobile efficiency."

    Senators who had previously been friendly to the auto industry said they were changing their position after growing weary of the industry's position. "I listened and I listened, year after year," Sen. Barbara A. Mikulski (D-Md.) said on the Senate floor. "And now, after 20 years, I firmly do believe it is time for a change."

    In the end, Senate aides said, Levin's group did not have the votes.

    Democratic leaders said the bipartisan backing of the compromise worked out in the Senate would help build support in the House when that chamber House begins debate on its energy package. Already, Rep. John D. Dingell, (D-Mich.) and House Speaker Nancy Pelosi (D-Calif.) have battled over fuel economy.

    In another Senate battle yesterday, Democrats lost a fight against oil companies when Republicans blocked a $32 billion tax package that would have poured money into alternative fuel projects by raising taxes on oil and gas companies.

    President Bush, meanwhile, visited the Browns Ferry nuclear power plant in Athens, Ala., where he touted nuclear power as a clean, dependable and safe source of electricity and promised to streamline the federal regulatory process to ease the way for the construction of new plants.

    "Nuclear energy produces no greenhouse gases," Bush said. "If you're interested in cleaning up the air you ought to be for nuclear power."

    I found some information that I believe could be beneficial in knowing the status of the pending I-140 case (also for I-485)

    This is called TSC Streamline procedure and a url link is given below.

    Based on that, AILA attorneys can send an email notice about the pending I-140 info. It seems like the application should have been filed prior to the processing date that shows up for I-140 for TSC. It looks like there is no 30 day window imposed as in the case of Service Requests.

    This email is supposed to inform USCIS about our pending I-140!
