I am trying to make a FOIA request for specific documents within my file.
I would like to have any document that states the exact date my AOS application was entered, such as the receipt (which I dont have). Does anyone know which form or document I can specifically ask for that will state this?

Hi All,
My cousin has a speech pathology (MSc) degreee from india and is trying for job oppurtunities in US( myself being a s/w i have no clue how this process works), can anyone of you throw some light on what kind of visa is needed, visa process involved, any consultants who can sponsor visa, and what are other things required to get started for this process. Any information is appreceiated.

Hi,
What is the difference between "reject" and "deny" in USCIS terms? Is it that reject is even before the case is processed and when application is returned back immediately and "deny" is later when the case is looked into and then the aplicant is found ineligible for whatever reasons?
If this is indeed the case how much time does one have after getting an RN to submit additional evidence he/she may have missed initially but before the case is processed?
any ideas from the adjucators manual?

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? My brother is working for company X.
They have recently got one labor cert approval. The ads are 3 months old which they used for one employee who is working in exactly his skillset and responsibility.
He is planning to ask the company to do one GC for him in same category.
1. Can they use the same ads for him also.
2. If they can use, then what amount of time will it save for him.
3. What are the different things one has to do, before filing labor like wage determination, with specific employee, and how much time each thing take. Are these tied to any specific employee, or can they be used for others also.
4. Somebody told me if valid ads are there, then it can save him 2-3 months, is it true.

Hi,
I am currently in Dallas. For applying a duplicate passport, it is OK if i Mail my application through USPS express mail which provides acknowledment . Can anybody please tell me if there is any problem with this?

Hi Gurus,
If you look at my signature, My 485 has been transferred to TSC from NSC and AP is still stuck at NSC. I have some emergent situation back home , I have faxed the doctor certificate and called USCIS using POJ method and the guy says it might take another month. wat the *****....tried infopass..my local office doesnt have no more appointments.
My questions:
1. Can I take Infopass appointment anywhere else which is not my local office?
2. Can I apply a new 131 application at TSC as my 485 is there now?
Someone pls advise.

I changed my employer 3 months back and didn't expect the dates to get current so soon. My labor with the new employer has just been filed. However, my previous employer told me that if I want to continue with my gc process with them, I need to be their employee again.
Does it make sense for me to do this ? My 485 will not get filed until 10 days from now because I have yet to start with the paperwork.
Will the dates retrogress by then? Please advise me folks.

Hello everyone,
My questions are about F1 to H1b change status.
I applied an H1b through a consultant company on April 2008. I received a notice from USCIS told me had been lottery H1b. However, until now my case is still pending. My OPT expired on Jan, 2009 and can't be extended. I am in the middle of the 60 days grace period right now. My questions are:
1. If the 60 days expire and my case is still pending, can I legally stay in US till H1b approved?
2. If my H1b is rejected and the 60 days expire, how many legally days can I stay in US? Do I have another 30 grace period days?
3. In my situation, what should I do right now? Do I need to find a school to keep my F1 visa? When is the best time to find a school?
4. Can I transfer H1b to another company during my H1b is pending?
I am very appreciate if you can answer these questions. :)

Hello,
My original I-140 in the EB3 skilled category was denied by the TSC & is pending @ AAO because the attorney's cover letter asked for the application to considered in the professional category, instead of the skilled category.
I have been told that while that I-140 is pending at AAO I can file a new I-140 under the "Other" category &they will adjudicate that case on the same Lobor Certification. Is that accurate for the TSC?
We will also file another EB3 Skilled category I-140 which obviously will be kept in abeyance till the AAO rules on my original application.
Can an attorney please advise if I can have 2 I -140's on the same Labor Certification for different categories?

How quickly can we change the job safely after receiving a GC?
The next job may not be of the same job description. Are there any formalities that we need to fulfill if we are changing jobs immediately after receiving GC(withink a couple of months)
