Hi,

I've been working full-time on EAD for the last 2+ years. I have a pending 485 application, on which my spouse is the primary applicant. I have never applied for H1B in the past, because I transferred directly from F1 (student visa) to this EAD.

My spouse also has an H1B, which is in it's 7th year (completed 6 yrs of H1B).

My spouse has been put on furlough (unpaid leave) for 3 months.
What are our options ?

1. Can my employer file H1B for me, and an H4 for my spouse ? How will this affect our green card application (on which my spouse is primary applicant) ?

2. How much time does my spouse have to look for another job (with similar job description), without being out of status ? Is there some grace period associated with H1?

I'd suggest contacting Adobe. Surely if you have a product that supports the file-format, and an upgrade of the firmware changes that, it's part of Adobe's support package to allow an upgrade of the Raw File support.

Is it possible? Pro-active Finger-Printing without appointment letter.

I have done my FP on March 1st 2005, since the validity is now expired, i called the VSC to enquire when and if i will be getting another FP notice soon.She told me that i can contact the local ASC(Application service centre) and go for the Finger-printing without any formal Notice/Appointment Letter.

Has anybody done this? ie has anybody done Pro-active finger-printing without appointment letter? Please reply.

I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

Hi metguh!
You cannot adjust the brightness of an object in Blend. What you can do, though, is alter the opacity or transparency.

For best practice from going from PS to Blend, what I would do is rasterize the image and import that image into your Blend project. Silverlight supports images that are PNG and JPEG.

Hello,

I have a RFE for my 485 according to the online status. My PD is current, and NSC's 485 processing time is now July 19, 07. My 485 RD was July 25, 07, so it is likely that they are working on adjudicating my case (and could have approved if there were no RFE).

I am still waiting for the RFE in the mail to know what it is exactly. But, assume that I fulfill their request and mail them the required items immediately, will I need to wait another 6 months before they check my RFE fulfillment? Or do they usually look at the RFE immediately (since they are already working on my case)...

Hi All,
I have come across situation where people who primarily filed 485 to NSC and their cases have been transferred to Texas or other places. In their notices the receipt date has been mentioned as the date on which the case received later by another service(TSC, CSC etc) center and not the date on which the case was first received by NSC.
So technically it is not the fault of the applcant and in some cases they lose 3 or more months for AC21.
Can someone or moderators explain if one can argue with USCIS to put the receipt date as the original for AC21 considerations.

My OPT ends dec 08 and my H1 got selected in lottery but received RFE in Oct and case is still pending. Can I go for OPT extension right now as there is just 1 month time to file it?? Or should I go for premium processing of H1 and then go for OPT extension filing depending on H1 case result??

If I go for OPT extension right now even when H1 case is pending,

1)What happens to that OPT extension case if H1 gets approved?
2)What happens to that OPT extension case if H1 gets rejected?

There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.

The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

2. worked in a hospital as a PI and postdoc training for three years
3. worked as research associate at University of Houston last year
4. working as research assistant professor(Faculty) at UH
5. Four foreign grants including national grant
6. several awards including the First Prize awards in foreign provincial health field
7. Published more than 20 papers, only two are SCI (one is PNAS published this year without citation so far), others are foreign language papers have more than 40 citations.

Now I am preparing files and will apply as EB-1b.

one of my friend worked here on L1 for couple of years for employer A.

then he got a H1 approved effective from Oct'07, with employer B.

but, he did not actually start working under employer B on H1 (payroll) until Mar'08.

he continued working under employer A on L1 ( has paystubs without any break) until Mar'08 and then worked with employer B on H1.

now he did a cap-exmpt H1 transfer to employer C, got H1 apporved and they are filing for GC labor PERM petition.

question is, while providing his previous employers info in the PERM petition,
can he say that he worked with employer A on L1 until Mar'08, even though his H1 with employer B is effective from oct'07?

appreciate any advice

One of my friends was in the same boat as yours and he said YES. No problem in visa issuance. And as per my friend, the officer already knew that he was attending school. I think the schools report all enrollment to USCIS.

Also my wife went for visa interview recently. She is on H4 and she also said yes to Q33.

Here is my story
July 2nd - Wife and I applied for 485\EAD\AP

The lawyer sent a single check(I know !!! I know !!!)
Our applications got separated.

Mine came back on Aug 30th and my wifes last week
We have now refiled
This time it has gone for "special handling"-bypassing the mail room

I haven't got the receipt yet

Anyone who had a similar experience or went via special handling for some other reason...
How long does it take to get the receipt nowadays ?
(I couldn't see any receipt update on USCIS- I guess most of the people are past that stage)

Will special-handling speed up my Receipt OR EAD OR AP?

Maybe few visas might get rejected because they would have tried to stay in USA permanently. Yes, you may apply for L1 visa extension using Form I-129, and L Supplement. Extensions of two years at a time may be allowed until you have been in the U.S. for a total of seven years if you are a manager or executive.

Hi Folks,

Can I travel on a valid / approved AP when my H1 Extension is in progress. This is my
situation:

Valid AP in Hand valid till next year.
H1B expiring 6/20/2011
H1B extension applied on 4/7/11 have rcpt notice.

My questions are this:

1.) When I enter US back in with my AP in mid July will that impact my H1B extension in any way.

2.) Without any EAD will I be Jeapordizing my AOS in any way.

I will be continuing to work with the same employer who is the sponsor of my current
I485.

Request your thoughts and inputs on this situation. Appreciate any replies/advices you may have.

I m not sure but I think he has to wait till he gets his citizenship . The other way to apply for Tourist or student visa. Tourist visa will be for short time and student visa will be hard to get if the Husband is Green Card holder.
Again, I m not 100% sure of this. some experienced people may be able to give you detailed information

Folks,

When an h1b transfer via regualr processing (california center) is pending...and say the person gets fired /layed off etc....

Can another h1b transfer be done with just the recepit notice and previous I-797?

What's the risk? Some companies are not willing to do premium processing even if the candidate is ready to pay the premium process fee.

If your H1B approved as a part of change of status from L1, Your current status will be H1B (You can check that on new I94) from the date H1B starts. In this case, You lost your L1 status and you need to start working with H1B employer. You need to take advice from your H1B Lawyer.

I am taking up a new job... The pay is good (10% more) and position is also of a senior lead developer.. I am not even leaving the area.. The company is 5 times bigger than my current one... Hello, My Labor got certified with PD Oct 2003 under EB2.
I have to file for I-140. Where can I check the status whether it is current or lagging back ? Also is there a Premium 140 for EB2 started or not yet? Since I cannot file for I-485 till it becomes available and current to my PD, does it make sense to file for Premium 140 or should I file regularly?
What are the steps for I-140 and any urls where I can see the status..?

She will have to go out of country and get stamping for H4 if her spouse is maintaining H1.
Automatic validation does not happen..

I need help for my friend. My Friend's spouse on H4 started to work on EAD. She does not work (or if she gets laid off), will she automatically get her H4 status? If not, what does she need to do to get back on H4. Her husband is on H1.

National Interest Waiver means that you do not have to have a job to petition for EB-2 GC. Consequently, there is no labor certification requirement. NIW petition is your petition; not some employers.

Immigration Lawyers Blog Has Just Posted the Following:
USCIS has added new online customer service options, including online inquiry and improved case status information features. The electronic inquiry is currently only available for case status information on Application to Replace Permanent Resident Card (Form I-90) and Application for Naturalization (Form N-400) cases that are outside normal processing times. Another added feature is online case status notification and change of address now available in Spanish. Hi,

Can one apply for Admission in US University while one is on Visit Visa in USA ?

If yes, will he/ she get I-120 while staying in US ? or one has to leave USA to get I-120, apply for f1 visa and then come on that visa ?

I will appreciate your answers.

I had emailed the Murthy team on Friday. Today Mr Vasant Nayak from Murthy.com emailed me back with concerns since i had emailed him from yahoo and my name was not in the list of volunteers. I have given him Admin and Walden Pond's names and have emailed both Admin and Walden Pond to touch base with him.

Murthy is a BIG source of traffic. He did say Murthy wud have to look a lot into us to put a link on their website. I request someone from the Board to pls get in touch with Mr Vasant Nayak. If you need his email pls send me a private message (as i dont want him getting spammed) ;)

Bill Clinton was in Cisco Campus last week in connection with some strategic meeting for Cisco, which they have it yearly at Monterey, CA. Clinton has made it clear to its employees, they come first in line in respect to immigration/Green Cards. Rest follow. So it may be a good idea if followed up with Bill. He supports Tech Industry. Apparently, employees have access to this info via Video On Demand internally.

Bill Clinton was a special invitee at Cisco. Would it be a good idea to connect with Clinton to seek support ? Perhaps too late ? Vinod Khosla and Bill are extremely close.
