Hello Michigan IV Members,
I would like to request all IV members living in Michigan to please respond to this thread. We would like to make the MI chapter much more active in our mission to solve many of the problems we face as legal immigrants. I think as a cohesive group, we'll be able to make a greater impact. Hi, I was in India when my husband applied for my H1B in 2008. I got it picked in lottery and got the approval too. I came to US on H4. After Oct 1st 2008, we applied for Change of Status to H4 to legally complete the work permit process. In the Change of Status applicatin form, my company accidently did a mistake of mentioning that Current status=H1B, New status required=H1B. :mad: USICIS, on seeing the application, took a decision to give me H4 with new I-94. I tried calling the USCIS helpdesk, but in vain. :confused:
1) Now what should I do to start working in H1B?
2) Was I correct in ging throughChange of Status? Or could I start working with the approval copy I had?
3) Could I apply for SSN with the 2008 approval copy?
Any answers would be greatly apprrciated!. Thanks in advance........

please advise what steps should be taken if I recieved the NL letter from KCC that I am selected for 2011 DV lottery.
I am in AOS in EB3 category, my H1B already expired, working on EAD.
My case number from DV lottery is very high (29***).
What should I choose - CP or AOS???
Should I fill and return back to KCC both forms - DSP-122 and DS-230 forms??? :confused:

YOu should go ahead and file your response to RFE. I had the same issue with my case when my attorney did not inform me of a RFE. After missing the deadline, I filed my repone through a different attorney explaining the problemand USCIS accepte my response.

Dear members,
I want to consult an employment/labor lawyer with regards to an employment agreement that I have signed with a desi consulting company in US. They have sponsored an H1b for me which I am yet to get stamped. I am in India right now and wanted to talk to a Labor lawyer who could tell me the effects of not joining this employer given that there are certain terms and conditions stated in the agreement. Could you suggest me some law firm in US where one can speak to a lawyer on the phone for a reasonable amount of money and seek legal advice.

Iam on H1 and my wife and 2 kids are on H4. we have been here for 3.5 yrs now. My petition has to be extended next year. My employer is delaying my GC process (not applied yet).
My Wife's brother who is a citizen is planning to apply for I-130 for my wife (not sure if it can be applied for me and kids as well, that is a different question).
However my main questions are:
- if he applies for I-130 for my wife, will it affect her H4 status or will I-130 application be affected due to her H4 status here?
- Will we have a problem when we apply for the petition renewal next year?
- Also will it affect the employer based Green card application (whenever int he future my employer applies for me)?

Hi,
Is it true that the old (i.e., July 1st - July 29th) filing fees still apply through July 27th - August 17th? The new fees (which would have been applicable from July 30th) will now be applicable from August 18th, right?
Is this true for I-485, I-765 and I-131 forms?

Does anyone understand what they mean by "Applicants entitled to immigrant status become documentarily qualified at their own initiative and convenience."
Does it mean that ppl file I485 at their own initiative (but thats not true since we cant file it until numbers are available), or does it mean that we should call USCIS and pester them and ask them "Is my application documentarily qualified ?"
Is that the same state as "preadjudicated" ?
Isnt it weird that AOS is the last group of people who get assigned numbers ? "CIS requests visa allotments for adjustment of status cases only when all other case processing has been completed."

TSC advises that they do not issue receipt notices for Form I-485A. The center has also advised that the deposited check is enough proof that the filing was accepted.

Attorneys please advice on my case below....
I applied for an I-485 during July Fiasco under EB3 category with an approved I-140(EB3). EB3 priority date is October 2005.
I also started another process later in EB2 category with same employer. My EB2 I-140 finally got approved recently and successfully porting the priority date from EB3 but did not file for I-485 in Eb2 yet.
Last week, my EB3 I-485 petition got approved even though my EB3 prority date is not current. I have got my welcome letter (I-797C) today. The COA is 26 on the notice.
My questions are:
Is it approved by error?
What are the risks involved for now and down the road.
Can we travel outside United States using this GC.
Will appreciate any advice.

I got offer for "Manager - Production Support" from my current company where I work as Tech Lead. I know there are issues with job code. I ran this through my attorney and this is her response:
"This would be considered a "material change" in your job for
immigration purposes. You can only make such changes after your green
card application has been pending for 180 days."
Is above correct? Has anybody accepted managerial position while I-485 is pending? Please advice.

I recently got my I797 approved (on Oct 19) but, the USCIS denied my extension of stay, and I need to go for stamping in Chennai (as per I797). My question:
1. Can I attend the interview in Canada/Hyderabad consulate instead of Chennai. Company attorney said that should be ok and filing I824 for change of consulate would take long.
In case you wanted to know more details about my case:
-Possess I797 from Employer A until Nov13, 2009.
-Filed for H1b extension with Employer B in Feb, denied in Jun15. payroll with Emp B Feb onwards.
-Re-filed for extn with Emp B in Aug4 finally approved on Oct19 but denied extn of stay.
