The LA Times reports on the Nevada governor's race which has Latino Brian Sandoval seeking to become the next Republican governor of the state. Sandoval has risked alienating his Latino base by endorsing the Arizona law and tougher drivers license rules. The GOP is hoping that Latino voters will vote for someone who looks like them even if he or she supports policies that are the polar opposite of what they believe. I doubt very much that will happen. Voters vote their interests first and then may look at a person's ethnicity if two candidates are similar in their views....

I meant Papu..We have not yet heard from IV Core..I know funds may be an issue to do hard lobbying..can we use soft campigning like letter and Fax campign to turn attention to the legal issue..I thought it was time to pick up momentum now..

My Wife had her COS from H4-H1, and I filed my I-485 in July with my wife as secondary applicant and already got our EAD,AP. We are planning to Visit India this month and my wife wants to use her AP while travelling back to US.
1. Is it advisable or are there any issues with using AP.
2. Can she use AP that she received as a secondary applicant and continue to work on H1B with her current employer
3. In Case her Status changes to EAD, can we reinstate her H1B at any point in time without counted against H1B Cap.
Pl Advise.

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. As most of you know, there is a conference call today(Sunday) at 3:00 EST. Please obtain the details of WHERE TO CALL and PASSCODE by calling 281-576-7185 if you do not have it already.
During the conference call: (The moderator would cover this but a little heads up never hurt anyone :) )
1. Please avoid using the speakerphone. It creates echo. :)
2. Press 4 * (four star) after joining the call to go on MUTE mode. When you want to speak press 4 * again and your line would be unmuted. You would help greatly by muting your line when listening to avoid the noise/sounds chiming in from about 80-100 lines.:)

My friend approved PERM in EB2 have qualification 3 year B.SC + 1 Year B.Ed + 2 year MSc. total 6 years of college, filed I-140 and was denied because of education. The labor is for Masters with 0-1 year experience. But they want 4 year degree prior to masters, citing EDGE database. Now the appeal is with AAO.
My question:
1. Do he can apply with the same labor for EB3 ?. What is the chance with two I-140 with same labor ?
( He filed I-140 for EB2 with that labor before 6 months of PERM certification. The PERM certified on April 2009 )
2. Or he need to do a fresh PERM with EB3 as a backup till the AAO verdict ? (takes 22 months)

- Bsc Computers (3 yrs) + MBA (2 yrs)
- GC - EB3, Oct 2003.
- Applied for 9th Year H1B in October. (H1B Visa expired in Oct)
- EAD and AP approved.
- Just got CRIS email of I140 & 485 denial notices (waiting for the USCIS letter for reasons).
- Previous company closed down and I had given Experience letter from a colleague, who is now on H4.
Questions?
1. Am I out of status already due to denial notices?
2. Will I get an H1B Extension?
3. If my lawyer decides to file an MTR, will I be allowed to work until my EAD/H1B is valid.

Many of us (including me) are frustrated in waiting for NSC approval of I-140.
