Hi,
I am on H1B visa. I have completed my last project and now on bench from mid of Nov'09. My employer (desi consultant) had asked me to send an Application for Unpaid leave so that he can maintain my H1b status. I sent a vacation letter for 2 Weeks and for which he has not paid me a bench salary. Now again he is asking me to submit another letter of unpaid vacation until the date I will get my next project.
My dilemma is how long should I entertain such requests from him and if in case I refuse to go on vacation what are my chances of being laid-off?
Will Employer loose any of his eligibility like no new H1/GC petition for short future up on lay off?

Just spoke to an IO at TSC, She told me that the case is at a place what they call "Pending Review and final decision"
I asked her whats the next step after this?
IO : Hope fully will be assigne to some one
I Asked, isn't this the place where all the cases are "Pending Review and Final decision"?
IO: a big NO...no no..this is not the place where all the cases are, I can't provide anymore info then this, I was just being nice because you called at 3:30 pm.
Any body who has thier case in the pool of "Pending review and final decision".
Honestly, I think its just a general status that she told me about my 485 case.

Due to a sudden demise of my wife's grandmother, my wife had to go to India last week. She is planning to come back by Nov. 15. I received the receipt notices for my wife's I-485, I-131 and I-765. My question is if the fingerprinting notice comes before she arrives and also if it is scheduled prior to her arrival date on Nov. 14; what are the options of rescheduling and can we get the date of our choice after Nov. 14. Also, I would be extremely grateful, if someone could upload a sample fingerprinting notice from USCIS. I couldn't find any where on the site.

I am resident of CA and have my I140 application approved from Nebraska. My I485 application was filed in TSC. Is this a issue since according to USCIS, CA residents should file in the NSC. Will my I485 will be rejected because of this issue.

Hi All,
How important is the location of the US embassy for getting the H1B visa stamping ? When applying for my H1B petition in April 2008, my lawyer had mentioned that I would be going to the US embassy in Germany for the H1B visa interview. I'm also aware that I could go to my home country for doing the same. However, does anyone know if I can go to Canada/Mexico, given that I have the visas to go to these countries ? I have a US H4 visa.

I am on US since Apr 2003 on L1B and it expires on Jan 25 2008
Last week my employer applied for L1A and it got approved. Approval notice says the new L1A visa is valid from Jan 26 2008 to Jan 26 2010(2 years)
I am planning to travel to india on vacation at dec 2007 and come back to US on Jan 1 2008
1) If I travel back to US on Jan 1 2008 without stamping L1A on passport, will the port of entry officer give I94 till Jan 26 2010 if I show the approved L1A I797 petition?
2) If I stamp L1A from India, when stamping the new L1A, I assume they will cancel my current L1B and stamp L1A which is valid only from Jan 26 2008. Am I correct? Then I will not be able to travel on Jan 1st 2008 since I dont have a valid visa stamped on passport at that time!
What to do ....Please help!

Recently we moved. So I did not apply the AP renewal(a two month window) till we move. But now my wife has extreme family accident/emergency in India. So we applied for AP online and went to Chicago field office (we went there because kid also need INDIA VISA STAMP) and to Milwaukee office with letter from document. They said that they would not approve. So I have sent the support document s for I-131 to the Texas Service center in overnight courier service today. I have H1 valid till may 2010. What are my options?
Does her travelling on H1 with AP pending will cause problems to I-485?

Employment based I485 is pending and priority date is not current, and wont be current until we have cars that fly. Have valid advance parole from EB I485. Plan to file a family based I485 next month and wait for receipt notice and then travel out of country.
Is it possible to return to US on the advance parole from EB I485 after filing FB I485? (Application for a second advance parole based on for the FB I485 will be pending as it takes ~3 months to process AP).
