    My Parents have 10 yr visitor visa. They came to USA, stayed for 4 months and left in July 09. Now they want to come again in October 09 and stay for 6 months. Is it possible? Do they face any issues at POE? Gurus please give your valuable thoughts or experiences?

    Hi,
    My I-140 was filed at VSC on 7/7/07. It was later transferred to TSC.

    In this case, would I base my I-140 processing time on VSC which is stucked at 04/01/2006 or TSC which is at 08/15/2007?

    I was hoping the later but I just called USCIS customer service and they said that A) it is based on WHERE YOU INITIALLY FILED and B) my application will eventually be sent back to VSC. I appreciate if someone can verify this. Thanks.

    Hi All,

    Would like to know if anyone has any H1B extensions approved/RFE's/denied (whether regular or premium processing) after the January 8 USCIS memo. Please indicate whether full-time or consultant.

    I applied for H1B extension - receipt date December 23rd, 2009. Upgraded to premium on January 21, 2010 (Jan 21 date updated in case status on USCIS website). Working as full-time - (empoloyer is not into consulting), Extension is for 3 years beyond 6 years, I-140 approved.

    Also, anyone know how long does it take these days for extensions under Premium processing to be approved.

    After we have filed for 485 and lets say we (me and my spouse) receive our EAD's. If I quit my job after 6 months of filing, can my spouse (secondary applicant) continue to renew her EAD's or would she have problems since I (the primary applicant) is no longer working for the company and maybe working for myself?

    Hi guys, cannot find this topic in previous threads. Appreciate it if someone can advise!

    My situation is: I'm still waiting to file for I-485 with approved PERM and I-140. I'll get married right after I submit my I-485 when visa number is available and petition for her I-485. Can my future wife in China take consular processing in US consulate in China while I'm just waiting for approval in US? Normally, does she get it earlier than me since she'd ask for consular processing?

    Hello,

    I have recently moved and did an Address update for my I 485 online this weekend. I noticed that there are LUDs on my EAD and AP application (I did not do an address update for these as these applications are not pending, I have received both few months ago).

    Did anyone else experience a similar issue?

    P.S Admins - I tried searching for any similar posts but the verification image doesnt display on my browser and i couldnt get any results. Please feel free to move this thread around or redirect to an existing one.

    Hi, my BIL was on H1, and lost his job, then he moved on to EAD, which he hadnt because my sister was on h4, then my sister got a job and went to home country to get it stamped as advised by their lawyer. Now her visa got rejected, maybe bec the company she got the job in is not very big. Anyway now for her to come back, my BIL has been advised to go back on H1.

    My questions are:
    1) How safe is it to go from EAD to H1
    2) Is it true that if you are on EAD and then if you try to go back to H1 the chances of it getting rejected are high? And if your H1 gets rejected then there are chances that your EAD will also get rejected?
    3) How long does it take to move from EAD to H1

    Any insights/suggestions/advises on the above would be greatly appreciated.

    Hello everyone,

    This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -

    1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?

    2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.

    3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?
