    Hi
    I am in H1B visa (valid until 10/2011), my wife is in F1 student (valid until 8/2011). We just got married 1 month ago in US. currently, we are staying in US. Now, she would like to stop studying for some reasons. To keep her valid stay in US, I have to transfer her f1 to h4. Could you please let me know step by step what I should do, what form I should take…etc.

    Does she need any visa interview after filing the transferring f1 to H4?

    Can she inform the school that she will stop studying right after filing visa transferring? (the school will stop her f1 if they know that).

    Hello,

    My firm is about to start greencard processcing for me and this is the first time that they are undergoing this process. They are searching for letter templates which decribes the employee eligibility and responsibilies in the firm and why they want to recommend greencard for this perticular employee. If anybody can upload such kind of templates/documents, that would be of greater help.

    USCIS has updated the H-1B cap count. (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=138b6138f898d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=91919c7755cb9010VgnVCM10000045f3d6a1 RCRD) As of December 8, CIS has received approximately 61,500 cases against the regular (non-Master's) H-1B cap of 65,000. However, since CIS sets aside up to 6,500 of this 65,000 for nationals of Chile and Singapore, it is possible that they will stop accepting other H-1B petitions soon, if not already. We are still filing new petitions, but with fingers crossed that they are not too late. If you need to file, please do so ASAP.

    Do we (parent) gets any benefits in terms of Visa status if you have child born in USA and you stay in US for certain years?

    In the other word:
    Once you have child born in USA is there any way to get green card based on your child citizenship?

    Once the US citizen child is an adult (I think 21 years old), then s/he can sponsor the parents for green card.

    Otherwise, no.

    I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
    I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

    Hi all,
    I am resident of CA and have my I140 application approved from Nebraska. My I485 application was filed in TSC. Is this a issue since according to USCIS, CA residents should file in the NSC. Will my I485 will be rejected because of this issue.

    Thats good to know. But what was your basic education? I mean did you had a full-time bachelor's (eg. Engineering, Commerce, etc) degree when you appled for H1b?

    Hi,
    I am currently on 8th year of H1-B, employer to file for 9th year H1 extension next week. Labor filed in Dec 07, denied in Jan 10, appealed immediately. Currently awaiting response to the labor appeal. H1 expires in Jan 2011.

    I work for a consulting firm and my client has been requesting me to join full time as an employee, willing to transfer H1 immediately. My question to the experts is

    If I change employer, will I have to start everything from scratch or can i continue the GC from where my current employer left?

    And given the current political situation (due to the economy), should I stick to current employer until H1 extension goes through and then make a move (if any possibilities exist)?

    Any advise is much appreciated.

    If you go to the USCIS website (www.uscis.gov) you can download the EAD application and the list of documents that you are required to submit. My understanding is that the location where you file your EAD is dependent on the State where you live. The EAd application instructions include information on where to file depending on the State where you live.

    My husband has 7 words in his name on passport. When we went for Driving licence they took a part of that whole name and issued the licence. But even the last name and first are totally changed now.
    How can we change his long name to short by taking only two words from 7. Does it come under Name change case or any other procedure.

    Hi everyone,

    Here is my situation and I need URGENT help.

    I am currently on L1-A for past 7 years (Visa expires Nov 07). During this span my company's attorney has unsuccessfully filed my I140 (twice was rejected at NSC and later TSC - due to 3 year degree and also my job description prior to transfer to US did not showed I have managerial/management function of a department). He refiled again this time with proper documentation and additional support letters from senior exec from my company.

    I suspect he has been making mistakes in my filing and my time is running out. I am thinking of using my own money and hire another lawyer to file a fresh I140/485. Is this possible since I have already 2 pending I140; one at NSC under EB-1C and another at TSC under EB-3?

    Please reply urgently if anyone has the answer to my question as I am running out of time.
