That is the only option i had open to me...
I am a plumber, no degree, but equivalent qualifications.. dont qualify for H1B, and once you have shown perminat intent you carnt go back to a temp visa..so catch 22 for me.. i had to go out there get a job, and then start the process. And yes my future employer has been very understanding about it. they have been waiting for me for 2 years so far...so am anxious to say the least to get out there.
Strange thing is, in the midst of all this, i have had my fee bill, paid that, and now my attorny has received my DS230, and sent that back yesterday?? so god knows what is happening. even though the dates arnt current.???
i give up trying to figure out what is going on over there. im hoping they will just finish up with it and send it to the embassy in london, so at least it will all be here even if it just sitting here waiting for a number to become available.
My be the november bulitin will show some kind of movment?

Yes, a plumber occupation would not qualify as a Highly Skilled occupation, it isn't on the list of in demand occupations. So - are you EB3 category? You need at least a 3 year degree for that (or if you don't have a degree, you need 3 years of experience for each year missing - so 9 years experience - depending on your unspecified "equivalent qualifications" - NVQ may or may not count, but I'm only guessing that this is what you have)
If you've been waiting 2 years, you have roughly 4 more years to wait imo, but to be honest, based on the info i have, I have doubts whether it would be feasible. If you can't get an H1B because your job wasn't applicable, getting an EB green card will be very tough.
I doubt Nov will have much movement. The ONLY reason for the movement earlier this year was total miscommunication between different governmental agencies, it is unlikely that this will happen again soon. Unused visa rush only happens at the end of the visa year, not the beginning.

This might work !! We should have state chapters collect a minimum amt of $50 or so and register people who agree to attend the rally. Then upon showing up on the rally day they will be reimbursed the fee...!

Most EB2's who are talking on this forum are idiotic, egostic and too much of themselves to think straight. Case in point Smugbee, SNathan and TonyHK. Since they don't have ead they want ead and thats all they care about. As long as they get to file 485 and get ead they dont care.
When an eb3 complains about waiting for GC he/she is a whiner and has to recognize the superiority of an EB2 getting GC before EB3 even if teh EB2 is 1 year in thsi country and EB3 has been waiting for 12 years.

Good news for some and not so good news for others. I have been waiting for my labor for last 4 years and have still not got the approval on hand. So I am not ready to apply for 485. Where as a friend of mine who came to US last year and applied for labor through perm 2 months back has his approved labor and can apply for 485. I feel this is kind of unfair. The dates should have progressed slowly but steadily instead of trying to create a mad rush now.

Does an MBA from a foriegn University Qualify for an exemption of CAP of EB2 Visas?
I was thinking one has to MS in a US university to qualify.

1) Any person with any advanced degree from a US university. There fore the following would qualify as examples:
a) MS in Computer Science
b) PhD in Mechanical Engineering
c) MBA
d) MS in Physics
e) MS in English
2) Any person with an advanced degree in STEM (science, technology, engineering and mathematics) from a non-US university (i.e. minimum of 18 years of education: 12 years of school + 4 years of bachelors + 2 years of masters) + minimum 3 years of work experience in US in a "related" field. There fore the following would qualify as examples:
a) 4 year bachelors + 2 years of M. Tech in Chemical Engineering from China + 3 years as a chemical engineer in a company in US.
b) 3 year bachelors + 2 yeas of masters + PhD in mathematics from India + 3 years in mathematics related field in a company in US.

(IMO, mcain is honest man and a well tested politican, dont want to comment about obama. dont want to get into the discussion about who is better. I wanted to comment about the power of a VP when she becomes a president if and when the president dies. people talk about the VP being a heartbeat away from the president but nothing about having an inexperienced and untested president...anyways...)

American presidential politics are highly media driven. When I came to this country and started following politics closely (12+ years ago), initially I was fascinated by all the discussions and transparent process etc. But over the years got convinced that its all a facade - election process here is as much flawed as in a "third world" country. Election 2000 is the biggest proof. Even worse, here people are easily swayed by non-issues. Media creates hype and media creates perceptions about a candidate, real issues and concerns takes back seat most of the times. Just see now - for last couple weeks everyone is talking about a VP candidate - the power of a VP is limited but yet everyone is talking about her and almost forgot the presidential candidate of the same party. The republican favoring press wants to project her as the next savior (which unfortunately seems to be working) and whip up their cadre. The democratic favoring press wants to project her apparent inexperience etc. We may soon see who is going to win in their "spin". In general republicans are pretty good in spin stories and project an apparently dumb candidate as someone with "whom you can have a beer with" and get him elected; now they might even succeed in projecting a 30+ year senator who backs current administration as an agent of change !!?!!! and people might even fall for that argument. Of course there are spin stories on the other side too.
Anyways, whoever wins this time - I think our situation wont change much and might even get worse. As the economy get worse - it would be very difficult to get any new bill favoring us (note I am talking about EB green cards not H1B). There is already a good effort by likes of numbersusa and programmers guild to project HR5882 as if it will kills jobs. As we know HR5882 is only for recapturing unused greencards the beneficiaries of which are mostly in this country already. It should have been a completely non-controversial bill - if we can see the resistance its facing we can imagine about any other bill that propose increase of GC numbers or something such. So prospects for anything better happening is very poor irrespective of who the next president is - that's my reading on this.

Are you kidding me? You are recommending http://www.usabal.com/ aka Berry, Appleman & Leiden LLP? DO NOT USE THIS LAW FIRM. RUN AWAY FROM IT AS FAST AS YOU CAN. They totally screwed up my case. My PD became current on June. I asked them repeadtly to file my 485. And I asked them for like 1 1/2 month. But they waited till July to file my case. So, I was affected by this visa fiasco. Their lawyer do not answer phone calls, they don't return voic mail and they do not response to email for 3-4 days. It is a totally BS firm. If possible go with small immigration law firm.
I agree. My case was approved online in early June, I kept asking them if they received papers from BEC, and they would not even take the time to check. As a result, I was unable to file in June even with a current PD. I ended up filing in July.

U know what, actually we all eb2 guys are very sad about the eb3 plight. And if we do get a visa number, we will request uscis to dsitribute it to eb3 category. does this make u guys happy now ???
why dont u think abt those guys, who filed in eb3 earlier, knew that the trouble is brewing, and switched jobs to be able to file under eb2. why you guys dint do that so far. dont blame uscis. they were, the are and they will remain a mystery for ever. its not our birthright. if DOS thinks they need more research grads, they will keep eb1 current, if they need more exp guys, they will improve the b2 category. And if they need more frsh grads, they will come to eb3. And if some exp person is stuck in eb3, he himself is to be blamed. dont blame anyone else for your ignorance of GC rules then.
So fact is we all are under DOS/USCIS mercy. 2 years back it was eb3 turn, now it is eb2 turn. Unfortunately no is blaming why ebI is always current. if that reason you can digest, then you should have the gall to digest this one too.

Its not over till its over :), and its not over yet by any means. I am willing to wait and fight ;) . Everyone has priorities in life, each person would view GC situation differently. For me, its not the ultimate dream, but just a vehicle to continue my journey for some more time (with peace of mind). I am definitely looking to gray my hair in my home country or atleast be there once I am grayed haired :D
Doing an MBA/PMI and looking for managerial job is the only realistic possibility for most, I don't think most people would wanna still be programming when they turn 40/45 (depending on how old/young you feel).
My gut feel is that there will be some kind of relief by end of 2007 or early 2008

Hi folks,

Currently applied for 485 and waiting for receipt
Will be applying for EAD/AP this week.
I am working Company XYZ, in State A, City A currently and will be transferring to State B, City B within the same company, with the same job designation/description etc., absolutely no changes on that front and virtually no change in salary but in compliance with prevailing wage etc. for State B, City B.
Also the transfer is not going to affect my 485 because of my 140 which said "relocation within the US may be necessary" and this was expected when I started my GC.
The issue is with a technicality - my PERM was for XYZ, Inc and the same company in State B is called XYZ Engineering Inc, technically 2 different companies and that's because every state has its own rules as to how a national company can be registered/operated.
Coming to my question re H1B:
My corporate attorney says that due to this technicality, my H1B needs to be AMENDED which according to my GC attorney is the same as applying for a new H1B but not having to wait in line. My question is whether this will have a negative impact on my pending 485/EAD/AP in any way.
Please advice. Anything will help.

Well. It certainly is a good news. Atleast for me. :) I would like to caution though that getting current does not necessarily mean getting approved. We have had cases from 2003/2004 PD members where they did not get approved for long time despite their date getting current.

I see that there is a lack of understanding about what "special" labor cert means.In the context of univ profs it means that the university is allowed to justify hiring an alien based on the fact that he was the BEST qualified candidate for the postion - that is, the univ is allowed to reject other minimally qualified applicants. This is currently not the case for other junta in either EB-2 or EB-3 .. if ANY minimally qualified american citizen / PR is found, the labor cert is denied.
If this is extended to EB2 / people with advanced STEM degrees as Frist Bill proposes, the labor cert will become quicker and painless for these folks (not to mention the immigration attorneys and the employers).

Its delayed process and not a deliberate effort that is the reason for you not getting your LC. I see no logic for you to su DOL. I do feel bad for you but I will say sit back as these things some time happens with every one. I am sure you will be in good shape as Backlog processing Center will be finishing remaining LC's very soon.
