    I think the issue of Economic Stimulus Package and H-4 dependents is losing the momentum. Where is everyone????

    I agree ---- I think the momentum is slowing down...

    at least can we not take any legal action for issuing out a rule (you can file MFS and get the stimuls and then amend MFJ) on 04/14/2008??? what about people who filed a long time ago as MFJ?? Because once you filed MFJ, the action is irrevocable!?! In my honest opinion, this stupidity of issuing out a clause the day before filing deadline deserves some "stir"!!

    I am in a lot of stress. Please help out if possible.

    Six years on my H1B expire in April 2008. I just got laid off from company A. My last day of work will be May 31st. I have LC and I-140 approved with company A.

    If I join company B starting June, and transfer my H1B to B, can it extend my H1B beyond 6 years based on the approved I-140 I had with company A? If yes, will it be for one year or three years?

    Gurus please help. I will be grateful.

    Don't worry..you still have time..start hunting for a job and you can transfer and extend your H1b for 3 years based on I-140 approval(beyond 6 years).

    Here are some of my own personal thoughts:

    How can one tell a percentage number for something to pass? What kind of data can we base our calculations on?

    Who said EB3 India will not forward next year? Did DOS say that? An individual lawyer is not Dept. Of State. I would like to see a written proof from DOS saying this so that we can plan ahead.

    There were many naysayers for the July 2007 bulletin. But IV was able to get it current again. So stop believing in predictions and believe in yourself.

    I thought that anyone close to the bill processes or people who work on those, should be able to predict; probably know by now if this (HR 5882) is going to happen or not. Pappu, I bet you must be in a better position than me to know (not to decide, ofcourse) about the plight of this bill. I would be surprised if you deny.

    The strong impression that I took away from the converstaion, and this is only my interpretation, not what was said explicity, is the following:

    The good news: the CIS backlog isn't as big as previously feared and their productivity is at an all time high;
    More good news: China EB3 had almost caught up with worldwide EB3 and is likely to do so next year;
    The bad news: when visa numbers become available again, India EB3 is going to be back where it was almost a year ago and it is not likely to move forward much in the next fiscal year.
    More bad news: 40% to 45% of the entire backlog is Indian EB2 and EB3.
    And barring, July 2007, EB3 I has moved only inches in the last 2-3 years and that's how much it would move in the next 2-3 years (and that's assuming a similar efficiency pattern that USCIS exhibited this year).

    I am not trying to open a new can of worms here but reminding of an old one that is already existing - EB3 India. The most priviliged to remain in this god damn queue for as long as they wish and even beyond that.

    Purpose:
    The Object of this motion is to enable the assembly, in order to attend to more urgent business, to lay aside the pending question in such a way that its consideration may be resumed at the will of the assembly as easily as if it were a new question, and in preference to new questions competing with it for consideration.     The motion to Lay on the Table is undebatable, and requires only a majority vote, notwithstanding the fact that if not taken from the table the question is suppressed.

    These are dangerous privileges which are given to no other motion whose adoption would result in final action on a main motion. There is a great temptation to make an improper use of them, and lay questions on the table for the purpose of instantly suppressing them by a majority vote, instead of using the previous question, the legitimate motion to bring the assembly to an immediate vote.

    The fundamental principles of parliamentary law require a two-thirds vote for every motion that suppresses a main question for the session without free debate. The motion to lay on the table being undebatable, and requiring only a majority vote, and having the highest rank of all subsidiary motions, is in direct conflict with these principles, if used to suppress a question. If habitually used in this way, it should, like the other motions to suppress without debate, require a two-thirds vote. [Note: The current (Tenth) edition of Robert's Rules of Order Newly Revised, does not permit this usage of Lay on the Table to suppress a question.]

    As motions laid on the table are merely temporarily laid aside, the majority should remember that the minority may all stay to the moment of final adjournment and then be in the majority, and take up and pass the resolutions laid on the table. They may also take the question from the table at the next meeting in societies having regular meetings as frequently as quarterly. If not taken from the table at the next meeting, however, the motion dies.

    Air India has the newest Boeing 777 LR non stop from JFK to Mumbai and Delhi. You can get tickets as cheap as 1000 usd roundtrip in economy.

    Cheapest business class where you can SLEEP! 3500 USD roundtrip to India. Find a cheaper business class where you can actually sleep and let me know.

    Best food! undoubtedly. New entertainment system with lots of Indian movie options.

    I am not sure if old sayings apply to Air India.

    Also we have jet airways , whose international service is in same class as singapore airlines, emirates and virgin atlantic.

    So why are we wasting time with such moronic european airliners? who cant let us sleep one night in their country.

    This year, I flew Lufthansa as that was the most viable option for me. The flight from Germany to Mumbai was substandard but the service was ok, cant complain. People were friendly at the german airport.

    In 2004 or 05, I flew air france one way on reward ticket, the FAs were rude to Indian customers but overall flight experience was smooth , comfortable and without hassle. People at french airport were ok.

    The lufthansa ticket was 1640 rountrip. I also considered air france, first they quoted me 2200 USD and then said, if I could compromise and flew alternate dates, fare would be 1840. The ticket agent sounded as if he was doing me a favour. No wonder when I showed up at the airport, the air farnce flight was almost empty whereas there was a big rush on lufthansa.

    CHANDU - I see airline is responsible for this. It is their duty to prevail on authorities otherwise why are they asking for business from Indian customers? In 2004 Delta used to fly via france and my brother had missed connection, he was provided hotel by delta in france for one night. Good that delta got fed up with european visa rules and started new non stop service.

    I got my green card 4 months ago.( by Lord
    Krishna's grace). I still contribute to IV on monthly
    autopay. I've been trying to help everyway I could from
    the inception of IV. I made numourous strangers during
    one time to talk about IV. ( My experience is that
    Desi's are so hard to convince. Their world is their family
    and four walls around them and save everypenny they earn).


    I've a friend who went to 5.00am to a autoshop
    to test drive and get a $50 coupon. But who would never
    bother to sign a letter for IV's cause( he is a green card
    waiter). I've tell him several times to do it.


    Needhelp, your best way would be to find one person
    committed like you to stand up. It will be much easier
    then.

    Very well said IV and I can tell you that you may very well be right when you say that 90% of people trust you guys. I am proud to be supporting an organization like IV and will continue to do so till we get success. It is not easy now and it was not meant to be easy but hey we will get there.     I'm so reliefed and excited to see the bulletin site after so many years...
    At first it look like a prank to me, like what happened last month.

    But now I 'm quite certain that that yes the dates did moved for EB2 category upto Oct-01-2005.

    Its really a great great news after a long long time !!
    Someday I will also complete my journey :)

    Hi all,
    Sorry to be asking again, but I needed some details on changing employers before Oct 1st.
    Here's the situation. I am currently on H4 and got my H1B approved this year through a consultancy with start date of Oct 1st 2007 (lucky to get through lottery).
    I only have a copy of the H1B approval notice.
    A few days back I got an offer for a full time position with another company (NOT a consultancy). And they are willing to do my H1B.
    I learned through this forum, that applying for a change of employer before Oct 1st with an approved H1B, is like getting a new H1B only i'm already counted against the cap for the fiscal year. And because it's considered "new" paystubs are not required. Hope I've got this much right.

    My questions are:
    1. Are all the documents required the same as when you apply for a new H1B ? Only you also have to add the approved H1B notice?
    2. Is it ok if a COPY of the H1B approval notice is sent? Consultancy had a verbal agreement with me that I should work for a year with them , but I don't think anything is on paper. Also they said they would only give me my H1B approval notice (original) once I was placed on a project with them.
    3. Does the job title have to be the same? Consultancy applied as Programmer Analyst, and the new company needs a Web Programmer/Server Administrator. Would that cause any issues?
    4. The new company plans to do premium processing, so if all goes well, can I start working with them as soon as the receipt notice comes in, or do I have to wait till I have the approval notice in hand?
    5. Can the consultancy cause any problems for me with respect to my H1B? Is there any way they can find out about this and revoke my H1B?

    If anyone has been through this and got their H1B approved with a different employer before the H1B start date, then please post your replies here. What were the hurdles , and what should I be wary of to ensure everything goes smoothly?

    To everyone who thinks rallies dont make a difference, as illustrated here by a skeptic : http://immigrationvoice.org/forum/showthread.php?t=13583

    This is not an attack post. Or a criticizing post. This is purely educational and please keep this thread clean.

    I know there are many out there who are snickering in their cubicles looking at the pictures of the rally and thinking "Look at these idiots, they think Congress will pass SKIL bill because they walked 1.2 miles with some placards and banners".

    Such thinking is reasonable. But only if you dont know how things work.

    Here is why rally of Sept 18th will be consequential:

    1. When you do a rally, people notice. People recognize organization and measure its strength. It stays in their heads for a long time and they keep Immigration Voice as one of the organizations they can ask for support when they push for their own cause. In Congress, things work based on compromise, consensus and consultation. People dont just sponsor legislations they believe in. They run it thru their caucus and leadership and do a vote count. To find out how many votes would they get if they came up with this new idea. Whether it will get 218 votes in House. Whether they will get 51 votes in senate. If its filibuster proof and get 61 votes in Senate. Whether it has committee support. Whether leadership offices are in agreement to put it in schedule. All this happens in background and there are people who are hired in committees just to do vote counts on proposed ideas. IF it turns out they dont find enough support, they drop it. If they think they can pull it off, they approach leadership (Speaker in House, Maj leader in Senate) to put it in queue.

    2. Let us say that Congressman X wants to sponser DREAM Act because of his constituency or a senator (like Feinstein) wants to sponsor AgJobs because food growers are having food rotten in absence of agricultural workers, a compelling cause. Now, when they want to pass legislation, they have to look for support and votes as described in item 1. When they fall short, they find ways to sweeten the pot. IF they see that a powerful organization will throw in their support and lobbying in favor of their bill if they attach a few of that organization's provisions, then they approach them. Immigration Voice did 138 lawmakers meetings (in House and Senate). They did the rally. They would consider IV as a organization that can help them PUSH for their legislation. Now we have a place at the negotiating table. If they attach our provisions (like recapture, or GC quota increase), then we can promise to do something for them. Like support the entire bill they are pushing for. They know that we can do rallies and we can do hundreds of lawmaker meetings. If Diane Feinstein (just an example) thinks that by adding skilled employment based reform provisions she can get IV's support and swing a few votes to help her pass her favorite AgJobs bill, then we have opportunity where the Senator would ask us what we want rather than us going and asking them to do things for us. One of IV members said that on the day of the rally, suddenly the office of her senator called her and scheduled and appointment to meet the same day at 4:00 PM. She had been trying to get the appointment but after they rally and Roll call newspaper ad (http://immigrationvoice.org/media/forums/iv/rollcal3a.pdf), they called her to listen to her. I heard about this from her just as the rally was over.

    3. CIR has recently failed. From some meetings, I got the feeling that CIR's failure has left a bad taste in mouth and many people in Congress as well as administration are very upset about it still. Now that we have done this rally, done lawmaker meetings, put a rollcall ad, did the media blitz, press conference, congressional reception (where 4 congressmen attended and spoke in IV's support), they know that it would be a good idea to keep IV on their side and put some of their things in a bill. Next time they write a bill (behind closed doors very often), they will consult us and ask us if they can do something for IV to win IV's full support. That's because by getting IV's support on their side for whatever they are doing, they can be assured that we wont oppose it but instead support it. With phone calls, Rallies, paid ads, lawmaker meetings etc. If they are really investing in getting a bill passed, they would include our provisions just to increase the odds.

    Strength respects strength. If we have the strength to do things and make a difference (rallies, meetings, receptions, press conferences, paid ads), then that strength begets more strenght because other powers want us to join hands with them so that they can do their favorite things (AgJobs, DREAM etc).
