Here are all the LC approvals for India in the last seven years.

Lets assume about 25% of pre-PERM LCs are India based on post-PERM data. Thus for fiscal 2004 (Oct 2003 thru Sep 2004) the total LC number is 43,852. Assume 25% of that to be India based on PERM data. That gives about 11,000 India LCs in 2004 alone (All EB categories combined). If you assume an average of 2.5 dependents then the number of visas required for all India EB categories for 2004 is 27,500 (11,000*2.5). The regular quota for EB2 and EB3 is only about 3000 each. That means 21,500 visas have to come from somewhere. I dont think those many visas are remaining for this year. Be prepared to see FIFO thrown under the bus and approvals with PDs that are all over the place. Please critique this analysis without piling on. Thoughts?

My MTR has been approved after 70 days and I-485 has been reopened. Though online status has not been changed yet but attorney received an MTR approval notices.

You are right in acknowledging that you may be wrong. Where you may be wrong? Maybe your "opinion" that EB2 should be given GC first before a single EB3 is entertained. Maybe the first-come-first-served argument is the valid one after all.
How does "my" argument make sense? I say, ok, give priority to EB2, but only within the same year. So, last years' EB3 has to be allocated first, before this year's EB2/EB3 are considered. And for this year, dont process EB3's unless EB2's for this year are done

I came in 2005 and was eligible in 2006 for EB3 as per company's policy. There was huge retrogression then and I was hoping EB2 would be better for GC and career. Anyway, that's not the point.
One thing I like is that people are acknowledging the porting is a loophole and plan to use it anyway since it suits them.

The point is, lets focus our energies on the main problem which all of us face, and not show any disgust on any one category. I know how it feels if someone is coming in front of me in my line.. But how can we stop them.
Lets bring attention to releasing those wasted visas, quota problems etc..
If equal spillover happens from EB1 to rest of categories, EB2 will affected immediatley.

Ok..I know I should read thru the older posts, but didnt get a sense of what is required in my case, so I am posting the question online.
My wife was on her independent H1B. she travelled out side the country and was readmitted on H1b. After that she turned in her 2 weeks notice and has started working for another company on her EAD.
We have not applied for our AP previously.
My question is this:
In Part 1 , Q3
Class of Addmission
Should she put H1B (last admitted as)
or would it be Adjustment of Status (since she is using EAD)
Also, what kind of supporting documents need to be sent?
I-485 copy
EAD Copy ( yes/ no)
I-94 H1B issued at POE (yes/no)
2 passport sized photographs?
anything else?

In fact I had the same thought! I did talk to a number of fellow participants on Sep 18th rally. Everybody seemed to welcome the idea!

It is very obvious that the total number of participants (put together) will be much higher in local rallies. For instance, I was the only one in the Sep 18th rally from my family. If it was local, all the four of my family would have been there! I am sure that this is the case with most of us!!
Sep 18th was a golden day in our strong movement! We learnt a lot from the dedicated organizers. Many of the participants (including myself) have gained practical experience about what is involved in organizing a rally. Let us build up on this experience to organize multiple but simultaneous rallies in different parts of the country (in almost all the state capitals and big cities).
I have a lot to share.... but can't do it more during my office time.
Shall come back to you during the week end.
Meanwhile, I would love to hear from others about this concept!!

I agree with you, my first reaction too was that this is practically impossible. Bill Gates was suggesting the proposal of "Instant GC" for anyone who completes their Master's degree in US. So may be some day this will become a reality.
I dont know how they are going to deal with immediate family members in that scenario. This does not sound like a bad idea but not everyone is lucky enough to afford doing their Master's in US. A number of them come on H-1B visas. Bill Gates was not against H-1B program.
I think there is a general consensus that H-1B program is being abused by employers. IEEE is suggesting to wrap it up while others are suggesting to keep the program but fix it, by providing the flexibility based on the current market needs and enforcing tough monitoring on the employers.
I must agree that the document is a perfect representation of how the H-1B program is being abused, which is unfortunate!

I am a july 07 filer, and now its time for my AP renewal.
I would appreciate if experts can give me suggestion regarding the AP Process?
or point me to thread having a information, I remember in 2007 we used to have a thread/blog with screen snapshots for AP filing.
My 485 is in Texas Service center.
1) ANy restrcitions for filing AP Electroncially
2) Fees
3)If Paper Filing do I have to sent seperate cheques for me and my wife or a combined cheque.

If you are employed in IT field, as far as I know federal skilled workers and AINP H1b stream are almost blocked except for managers. Canada immigration program has a list of occupation category; if you work in one of the listed classification then you can apply for PR. About an year back federal skilled worker deleted all computer related classification but managers. In May 2009, AINP did the same and now only IT managers are eligible.
If you are employed in non-IT category, you may still be eligible.
But AINP looks "little" better when compared to other immigration programs.

Just being paranoid, but is 797 the number for the "receipt notice" as well as notice of action? I know that when H1 or 140 is decided, the notice of action form is called 797. I know that the USCIS seems pretty clear in the FAQ, but just wanted to confirm that a receipt is also called 797

logically speaking, it should be good for us. Had it not been for the conservative house republicans and speaker hastert, CIR along with its many favorable provisions for us could have been law by now. So with that obstacle out of the way, things should be better for us.However, politics is never logical and immigration reform is neither the top priority nor a done deal with the dems. From our perspective, we got to raise awareness about our cause all over again since most of the new congressmen will be unaware about problems afflicting skilled legal immigration.
Looking at few early Election results, it seems that Dems are winning. Needs to check how they will be do good for us. Any thoughts?

My I-140 was filed on July 9, 2007, USCIS received it on July 10, 2007. Just heard from lawyer that they received my 140 receipt. The date on the receipt is July 16, 2007. My I-140 was sent to NSC.

Is there anyway we can work on reporting fraud desi consulting companies to the USCIS so the fraud EB applications can be cleaned up from the system? That may help in clearing up the backlog. These desi firms have sponsored people in EB-2 successfully. I have worked with these IT 'professionals' who can't speak a word of English and hardly have any idea what's going around them. I am serious, this should be considered and evaluated. No offence meant to anyone but those who have had a wonderful educational background and don't work for desi 'firms' ought not to worry since this doesn't target them at all. Thanks.

Guys who got NOID/Denied 485, quick question.
Looking back, do you think it was worth making the job move using AC21? Is it really worth the time, money, anxiety, sleepless nights that you go through during NOID-MTR?
For people getting layed off, they have no choice but to use AC21, but for rest of us, why not continue with the job you are currently in and let the GC take its turn rather than risking it?
PS: I am in US for past 5 yrs with May06 PD. I am just trying to get an opinion here, so don't flame on me. I was comtemplating on using AC21 but reading all the NOID stories, i am bit hesitent now.

They are just shit scared, they do not want ANYTHING to happen to their Green Card - they did not join IV because they are scared that something will happen to their GC petition.
Knowledge is power, ignorance is bliss. I used AC21 because I was with desi employer - though our relationships were good, as the client filed for chapter 11, my desi employer who has a poor accounting system figured out that there were a lot of invoices unpaid which he never bothered to follow up and lost a lot of money and rubbed everything on me. So it was a good time for me to get out of such mess as I already finished 180 days after filing 485 and as such I had been doing my own marketing, negotiating my own billing rate, and always billable so I utilized this opportunity to get into a more stable job which is decent paying.
I talked to various lawyers and was aware that AC21 has some risks involved but everything can be sorted out. I weighed options, though I could stay with the company, I moved on.
So it is your choice.
