Based on Visa Bulletin report, it seems like massive retrogression is likely for EB3 as well as EB2 :( for the rest of the year. Many have ported and some hibernating applications are now active. :(

As far as my knowledge goes, the I 140 substitutions are no more accepted by USCIS. I may be wrong. Other members can comment..

The key is revocation vs. substitution. Per discussions with immi attorneys, AC21 portability is not explicit on what needs to be done if I140 is substituted by previous employer and NOT REVOKED, and the applicant is eligible for changing jobs (same desc and 180 days pending). The fact is that this loophole leads to illogical scenario--2 applicants taking benefit from same I140.

A lot of lawyers who are really committed and sincere to their client's clause: Getting them Green Card, are working overnight and over the weekend also so that their client can file I-485 ASAP and on the other hand few law firms are acting as slackers and not even responding to their client's emails.
Anyway, I am interested in knowing everyone's experience ( good or bad ) with law-firms and their recommendation.
My Own Case:-> I work for a multibillion dollar telecom company and joined this company almost 15 mos ago with a promise that they would start my GC immediately. Till Now, they have not yet file my labor. Their lawfirm is Larrabee http://www.larrabee.com/ in sanDiego. I don't have much experience with them as my application is still in my company's internal queue but based on the basis of my little experience, I would certainly not recommend them

I still can't connect Republicans with legal immigration. I was asking before, what Republican sponsored bill was passed that supports legal immigrants?
They are all corrupt and they are all actors. I am talking about all politicians, in this or any other country. They are not leaders, they are all politicians.
Republicans project themselves as pro-business that is expected to create more jobs for Americans. They support legal skill immigrants not because legal immigrants are "beautiful", but because legal immigrants help big-business make more money. For republicans this is not the question of pro or anti immigration, it is primarily 'wealth creation' issue for big-business. Republicans usually do not support provisions for employee protection as it hurts the agenda of big-business.
Don't get me started about Democrats who are no different. Its just that Democrats don't care about skilled immigrants at all and they only care about big business during fund raisers.
Even Bush was not able to push Republicans to support CIR. McCain was forced to disavow his support for CIR just to win the nomination.
Bush did what he could to push for CIR. If all Democrats would have supported, CIR would have passed in 2006. In 2007, if it was not for blue dog democrats, CIR would have passed in 2007. But democrats had decided to set their priority for not forcing their congressmen/women to go through a difficult vote which may possibly make Democrats lose the election in 2008.
On the other hand, it was always at the time of a Democrat President when immigrants had freedoms. VB was almost always current. You can get driver's license easily.
Difficult with DL is primarily due to the fallout of 9/11, it is not because of a democratic or republican president in office.
Again, going back to the question, what Republican Bill was passed in support of us, legal immigrants?
Most legal immigration bills were passed/worked upon by Republicans including AC21 bill. Not because republicans are pro-immigrants and democrats are anti-immigrants, but the reason is republicans are supposedly pro-business.
HR5882 is co-sponsored by Sensenbrenner. He was the biggest opposer of recapture bill in 2005 before he decided to co-sponsoring recapture bill HR5882 in 2008.
Look, it is not correct to generalize that Republicans are anti-immigrants and Democrats are pro-immigrants or visa-versa. They are all actors and each individual lawmaker decide their position based on how it would effect their re-election. Wait till you see Durbin show his act, most people on this forum, legal tax paying law abiding people will all be toast. Just wait and watch, writing is on the wall.

I think DOS knows a damn when they move the dates (I think everybody agrees with that) They still move their dates based on demand of approvals from last qtr / month and they calculate the expected demand. I think they are probably making the assumption that everything is normally distributed (atleast this is my assumption). I dont believe in numbers, but lets say for example :
If you see that for March they have about 43 EB3I applications current and through April they have made 55 EB3I current and they added only 8 apps through 2 months. (Also Chennai consulate appointment numbers decreased from 10 to 5 from March to April) But on the other hand, by making EB2 Dec 2003 they have added 150 applications to the pool. This does'nt make any sense.
I agree that there could be indians who applied EB3 and dont work for IT and not have access to or perhaps dont want to track them, but again it should not be too much when compared to EB2.
So in my opinion, if DOS calculates the same way they do the EB3I dates should move to some where in Jan 02 in three months and the last quarter is going to move to the end of 2002.

How does passing CIR help us? I didn't really have the energy to go thru the whole bill but it didn't specify what "line" those 20+million ppl who eventually get amnesty will be processed in. If they line up on EB3 or a supplementary bill in the future decides to allocate some EB3 to a "Schedule B" (just for example), then we are right back to where we started (but add more years to the waiting).

Dont take it too seriously .... and disturb ur sleeps and all .... See, if the receipt has to come from somewhere else, then its a different story ..... USCIS is the one who has to generate the receipts and we have to send the receipt back to USCIS ....
If USCIS themselves are delaying the recipts for whatever reasons, its their problem to handle .....We can show many other proofs as initial evidences ....Its no big deal for them to verify this ...
Its not that we r missing an important report such as medicals which USCIS can get only from the applicant .......
More than anything, I just believe in God ....
Our applications WOULD NOT BE REJECTED ... JUST RELAX ...........

Looks like USCIS is sending more denial letters on AC21 cases these days, a lot of VOs may not have been trained on AC21.
I took infopass this week to find out status of my case (AC21 responded to NOID and case reopened and lot of soft LUDs) - the VO was trying to be judgemental instead of looking at computer and answer my question. She said "If you change job and 140 is revoked, there is no way your 485 will get approved" and when I insisted her to look at computer and let me know status, after some nagging, she looked and told me case is pending and NC cleared and I will receive a decision sometime but not very soon.
Believe me, a lot of VOs do not know AC21 stuff.
Let me wait for actual denial letter.

BA : They are prompt service folks , but I cant tolerate their attitude.
Luftansa: Again good, but cant take the attitude.
cathay/singapore/korean/Arab emirates: Nice , can bet my time and money for my travel on them
Others : I dont really care.
