Hi
All who are on H4 visa ,is there a way out that we all can write an email or letter to the USCIS or the law changing authority to change the H4 law and get right to work ,I mean one nicely drafted mail or Letter with all the problems highlighted and the disadvantages which the spouse and the H4 are facing .I am mentioning some points which we can write
1.H4 cannot work any where in the USA,not even for an hour
2.Green card is years away.
3.Just be at home and keep on asking money from your spouse for everything you need.
4.With the 65000 quote every one on H4 cannot get an H1.
5.Every one on H4 is not necessary a computer professional or having a 4 year degree possible 3 year or may be less so they cannot qualify for an H1.

Thats right, eventually when the H1B emploee gets Employement Authorization through GC process, the H4 spouse automatically becomes eligble to work and have better opportunities than any H1B holder. Why can't a H4 have a work authorization same as J2 or L2 or E2. Does ImmigrationVoice considered this thought and thinks as a good point to raise it to the senate in one of their efforts?

What freedom and justice you are talking about? The folks on this forum are not responsible for you misery. So stop venting you frustation here. Though, I sympathize with you situtation but unfortuantely the whole legal system is unfair.
What we have done here is a good start, soon we will lobby for passing of SKIL bill . And the day is not far when you too will be benefitted by these efforts

I did not want to initiate that discussion because it may be a long one, but let me share my experience:
My recommendation is that folks take an MBA only if you already have a firm position in mind that you want to go for an executive or upper management position in the future. That line of thought is specially applicable when you are paying the whole thing from your own pocket !!! Before working in a management position or taking the MBA, I did not know how much I liked the idea of becoming a CIO or CEO. I tought I knew it, but until you actually experiment it, as many things in life you don't know for sure. Well, after completing 50% of the program I realized that was not my short or mid-term goal to work as an executive reading accounting net income balance sheets or maketing professional, even if I had the GC handy.
In my personal opinion, taking an MBA merely to enhance your project management when you are PAYING FROM YOUR OWN POCKET it may be a very bad strategy. If others are paying for you, of course that is fine, but it is not the case for many of us. I had only one or two courses related to project management anyway.
If you just want to enhance your project management skills, you might want to invest in way more direct courses such as PMP, ITIL, Microsoft Operations Framework. You should be able to complete those with a fraction of the cost and time of an MBA and probably achieve more return and knowledge than what the MBA can offer you when it comes to project management.
For those who are sure you want to read balance sheets, work with marketing analysis and go away from the hands-on experience, then MBA may be right for you.
I don't want to discourage you, but there are documents out there showing that MBA's are overrated and the importance of it is under scrutiny. Since I already found offers from multiple employers who were willing to pay 100% (if you are a qualified professional like us, it is not difficult to find employers willing to pay for it once you can change jobs) personally I thought I could wait a little longer to get the MBA and invest in IT certifications now paying from my own pocket.
Just my humble opinion.

Even mine is EB2 with level II. I did not see a single case from my company with Level III or Level IV but still a lot of them are EB2.
My 140 approval says: Mem of Profession w/Adv Deg, or Exceptional ability Sec 203 (b) (2).
My understanding: this is EB2.

Thanks. I know I am bugging you with my questions because I am filling all the forms today and sending. I have one question :)
For AP documents, it says we can submit any document issued to you by USCIS showing your present status in US. Now, currently I am on H1B. So should I send them my I797 approval document or EAD copy? Also in there instructions they are asking to send copy of an official photo identity document showing your photo, name & DOB? Can it be PP/DL/EAD?
Your status will be shown buy copy of I485 receipt. AP requires the following:

They did it for their country and fellowmen to be free from the clutches of oppression (a much serious issue than green card i think). Although even that is extended selfishness (cos of being Indian or African American) but they dedicated their entire lives for that cause.

Hi Gurus,
Right now I am working for Company A and VISA with company A is valid till September 30 2007. Company B applied for Regular H1-B transfer (Receipt Date May 12) and it is still under process. I will be joining Company B on 1st October 2007.
Now due to some emergency I am traveling to India on 11August, 2007 and will come back on 11 Th September 2007. Also I can’t go for VISA stamping in India for Company B as I have not got my H1 Approval yet.
Given the above scenario, will I have any problem at the port of entry as my H1b transfer from company B has not been approved yet?
What all documents I have to carry to reenter safely?

I guess they are very low in numbers. Thats why they moved the PD to 2006.

USCIS is clearly requesting for two passport size photos with AP application.
It is surprising that most people don't even read basic instructions with the USCIS forms, and go on asking questions and sometimes giving (wrong) suggestions in IV. Yeah, it takes a few minutes to look through the instructions but searching/writing/replying/ doubting/making mistakes/giving red dots/ etc in IV takes more time, I think. :)
I e-file my AP and I got receipt notice immediately after completion of e-file. And I got the direction on the PDF listed bellow. USCIS clearly mentioned DO NOT send Copy of ID, Photos unless they requested. That�s why I didn't send any documents to USCIS.
